Personal data

Personal data is data relating to your person. This includes your name, address and email address. You do not have to reveal any personal data to be able to visit our website. In some cases, we require your name and address and other information in order to provide you with the desired service.

The same applies if we supply you with information material on request, or if we answer your inquiries. In these cases, we will always point this out to you. Furthermore, we will only store data you have transmitted to us automatically or voluntarily.

Access and activity logs ("server logs")

When you visit our website, our web servers store the IP address of your Internet service provider, the website you visit us from, the websites you visit with us, and the date and duration of your visit. This information is absolutely necessary for the technical transmission of the web pages and secure server operation. A personalized evaluation of this data is not carried out.

Error logs

Error logs are generated for the purpose of identifying and fixing bugs. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. This information is absolutely necessary to ensure that we can react as quickly as possible to potential problems with displaying and implementing content (legitimate interest). A personalized evaluation of this data is not carried out.

Cookies

When you visit our website, we may store information on your computer in the form of cookies. Cookies are small files that are transferred from an Internet server to your browser and stored on its hard drive. The legal basis for the use of cookies is art. 6, par. 1 lit. f GDPR. Only the IP address will be stored – no other personal data. This information stored in the cookies allows us to automatically recognize when you visit our website again, facilitating the use.

Google Ads

This website uses the online advertising program “Google Ads” and within Google Ads, the conversion tracking, a service of Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (“Google”).

Google Ads is used to draw attention to attractive offers of this website with the help of advertising materials (so-called Google AdWords) on external websites. It can be determined in relation to the data of the advertising campaigns how successful the individual advertising measures are. Thus, this website has an interest in showing you advertisements of interest to you, making the site more interesting to you and achieving a fair calculation of advertising costs.

The conversion tracking cookie is set when a user clicks on a Google-served Ads ad. Cookies are small text files that are stored on your computer system. These cookies usually lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of this website and the cookie has not yet expired, Google and this website may recognize that the user has clicked on the ad and has been redirected to this page. HubSpot

This is an integrated software solution that we use to cover different aspects of our online marketing. This includes, among others: email marketing (newsletter, together with automated mailings, e.g., for provision of downloads), social media publishing & reporting, reporting (e.g., traffic sources, accesses, etc. …), contact management (e.g., user segmentation & CRM), landing pages and contact forms.

Our registration service enables visitors to our website to find out more about our company, to download contents and to provide their contact information, together with further demographic information. This information, together with the contents of our website are stored on the servers of our software partner HubSpot. We can use it to make contact with visitors to our website and to determine which of our company’s services are interesting for them. All information collected by us is subject to this data privacy policy. We use all information collected exclusively for optimizing our marketing measures.

The legal basis for the use of HubSpot’s services is art. 6, par. 1 lit. f GDPR – justified interest. Our justified interest in the use of this service is the optimization of our marketing measures and the improvement of our service quality on the website.

Microsoft Bookings

On this website, we use Microsoft Bookings for online appointments. Microsoft Bookings is software provided by Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18 D18 P521.

It is a software solution integrated into Microsoft 365, which enables us to book an appointment with one of our employees. The connection to the service is only established when the online booking function is accessed on our website, in an e-mail or in a newsletter. To make an appointment, the entries in the appointment form are transferred to Microsoft.

Our appointment service allows visitors to our website to easily make a telephone appointment with our staff when needed.

The legal basis for the use of the service of Marketing is Art. 6, para. 1 lit. f GDPR – legitimate interest. Our legitimate interest in the use of this service is the optimization of our marketing activities and the improvement of our service quality on the website.

If you subscribe to our newsletter, then we store your email address and use this to send the newsletter. Your email address is not made public or disclosed to third parties.

  • Purpose of use: Sending of the newsletter requested
  • Storage period: As a general rule, the data is only stored for as long as is needed to fulfill the purpose. For the newsletter, the data are stored as long as it is expected that a newsletter will be sent and as long as you have not objected to the use of your data.
  • Legal basis: art. 6, par. 1 lit. a GDPR – consent
  • Revocation: You can unsubscribe from our newsletter at any time using a link included in each issue. We will then delete your email address from our distribution list. As an alternative, you can also unsubscribe from our newsletter at any time by sending an email to content@ibodigital.com.

Online Appointments

When you make an appointment online, we save your entries and use them to contact you. Your entries will not be published or passed on to third parties.

  • Purpose of use: agreement of an appointment
  • Storage period: The data is usually only stored for as long as it is necessary to fulfill the purpose. For the purpose of arranging an appointment, the data is stored until the contact is established.

Security

We have taken technical and administrative security measures to protect your personal data against loss, destruction, manipulation and unauthorized access. All employees and service providers that work with us are bound by applicable data protection laws.

Whenever we collect and process personal data, it is encrypted prior to transmission. This means that your data cannot be misused by third parties. Our security measures are subject to a continuous improvement process and our privacy policy is constantly being revised. Please make sure you have the latest version.

Rights of data subjects

Right to information

You may request from us to confirm whether your personal data is processed (art. 13, 14 GDPR) by us.

If such processing is the case, you can request the following information (art. 15 GDPR) from us:

  • the purpose for which the personal data is processed,
  • the categories of personal data being processed,
  • the recipients or categories of recipients to whom the personal data relating to you have been disclosed or are still being disclosed,
  • the planned duration of the storage of your personal data or, if specific information is not available, criteria for determining the duration of storage,
  • the existence of a right to rectification or erasure of personal data concerning you, a right to restriction of processing by us or a right to object to such processing,
  • the existence of a right of appeal to a supervisory authority,
  • all available information on the source of the data if the personal data is not collected from you, and
  • the existence of automated decision-making including profiling (art. 22, par. 1 and  par. 4 GDPR) and, in certain cases, meaningful information about the data processing system involved, and the scope and intended result of such processing on you.

You have the right to request information on whether your personal data will be transmitted to a third country or an international organisation. In this context, you can then request for the appropriate guarantees (art. 46 GDPR) in connection with the transfer.

Right to rectification

You have the right (art. 16 GDPR) to have incorrect personal data stored by us corrected. You also have the right to have an incomplete data set stored with us supplemented by us.

Right to erasure

You may request us to delete the personal data (art. 17 GDPR) concerning you, if

  • the data has been processed unlawfully,
  • the data is no longer necessary for the purposes for which they were collected or processed,
  • you have withdrawn your consent to the processing of the data and there is no other legal basis for the processing,
  • we are subject to a legal obligation to delete the data,
  • you are under 16 years of age or
  • you have objected to the processing and there are no overriding legitimate reasons for the processing on our part.

Right to restriction of processing

You may demand that we restrict processing (art. 18 GDPR) in the following cases:

  • if you dispute the correctness of the personal data for the duration of our examination,
  • if you have requested deletion and we cannot or may not carry out a deletion,
  • If you require the data for the assertion of claims, but we would be obliged to delete it because the data is no longer needed  for the purpose of processing, or
  • if you have objected to the processing and a final decision has not yet been made.

In these cases, we will mark the data with a blocking note and not process it further.

Right to data portability

You have the right (art. 20 GDPR) to receive your personal data given to us in a structured, standard and machine-readable format. In addition, you have the right to transfer this data to another person without hindrance by us who was initially given the data, given that

  • the processing is based on a consent in accordance with art. 6, par. 1 s. 1 lit. a GDPR or art. 9,  par. 2 lit. a GDPR or on a contract in accordance with art. 6, par. 1 s. 1 lit. b GDPR and
  • the processing is done by automated means.

In exercising this right, you also have the right to maintain that your personal data relating to you are transmitted directly from one person to another, insofar as this is technically feasible. Freedoms and rights of other persons shall not be affected.

The right to data portability does not apply to the processing of personal data necessary for the performance of a task in the public interest or in the exercise of official authority delegated to us.

Right to object

Subjective to your situation, you have, at any time, the right to object (art. 21 GDPR) against the processing of your personal data pursuant to art. 6, par. 1 s. 1 lit. e or f GDPR. This also applies to profiling based on these provisions.

We will no longer process the personal data concerning you unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or the processing is for the purpose of enforcing, exercising or defending legal claims.

If the personal data relating to you are processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data in regard to such advertising; this also applies to profiling insofar as it is associated with direct mail.

If you object to processing for direct marketing purposes, your personal data will no longer be processed for these purpose.

Regardless of Directive 2002/58/EG, you have the option, in the context of the use of information society services, to exercise your right to object to automated procedures that use technical specifications.

Right to revoke the data protection consent declaration

You have the right to withdraw your consent at any time. Please send your revocation to the above mentioned data or by email to privacy@ibodigital.com. The revocation of consent does not affect the legality of the processing carried out on the basis of the consent until the revocation. 

Automated decision on a case-by-case basis, including profiling

You have the right (art. 22 GDPR) not to subject to a decision based solely on automated processing including profiling that will have legal effect or affect you in a similar manner.

This does not apply if the decision

  1. is required for the conclusion or execution of a contract between you and us,
  2. is permitted by the Union or Member State legislation to which we are subject, and where such legislation contains appropriate measures to safeguard your rights and freedoms and legitimate interests, or
  3. with your expressed consent.

However, these decisions must not be based on special categories of personal data under art. 9, par. 1 GDPR, unless art. 9, par. 2 lit. a or g GDPR applies and reasonable measures have been taken to protect the rights and freedoms as well as your legitimate interests.

Right to complain to a supervisory authority

You have the right (art. 77 GDPR) to complain to the supervisory authority, if you believe that your personal data is not processed according to GDPR by us.

Changes to this Privacy Policy

We reserve the right to change our privacy policy if this should prove necessary due to new technologies. Please make sure you have the latest version. If fundamental changes are made to this privacy policy, we will post them on our website.
